- PRIMARY GUEST: The primary guest on the reservation must be at minimum 21 years of age and must be present for the entirety of the reservation and assume responsibility for the non-compliance of all Parties during their reservation. The primary guest will be required to submit personal identification documentation which should match the payment method on file and that of the Primary Guest. All reservations must be paid for, and T&C agreed to by you. You agree that non-compliance with our policies will result in immediate cancellation of the reservation/expulsion from the property, and no refund will be issued. To dispute any claims please submit them in writing. Please include any necessary details and photos to support your dispute. You will have 7 days from check-out to submit your dispute.
- CANCELLATION POLICY: Reservations for this property are refundable in full up to 5 days prior to Parties check-in date, if the Parties cancel on or after this date, a refund will not be issued.
- PAYMENT POLICY: Airbnb is the merchant of record for your reservation. Euphoria Vacation Homes has no access to your payment details or information regarding your due dates. Please reach out directly to Airbnb for assistance. All optional fees will be sent securely via the Airbnb portal and can be viewed at www.airbnb.com/resolutions .
- DAMAGE WAIVER AND INCIDENTALS: Our properties are inspected before and after each reservation, Parties agree to pay for any damages to the home caused by the Parties, excessive cleaning required, missing or damaged items, or any other accidental damage to anything within the home during Parties reservation. Parties shall, on arrival, examine the home, all furniture, furnishings, appliances, fixtures, and landscaping if any, and shall immediately report, in writing, if any are not in operating condition or are in disrepair (this applies to functionality, small blemishes / wear and tear is to be expected, especially during high demand seasons). Reporting repairs does not give Parties the right to cancel this Agreement or receive a refund of any payments made. Parties shall properly use and operate, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Parties will immediately notify Euphoria Vacation Homes of any problem, malfunction, or damage.
- Parties reservation was charged an incidentals fee: In lieu of a traditional security deposit charge or authorization hold for a large sum, we will instead charge a one-time non-refundable incidentals fee to Parties stay. This fee acts as insurance for minor damages. Parties may elect to increase their incidentals fee for more coverage ($49 for $500, $99 for $1000, $149 for $1500, $199 for $2000 and so on and so forth). **IMPORTANT**: Parties must report to Euphoria Vacation Homes, in writing, any damage that has taken place during their stay prior to checkout, otherwise the incidental fee coverage is null and void. In this case, Euphoria Vacation Homes reserves the right to charge the full amount of repairing or replacing the damaged items to Parties. Parties insurance coverage amount ($500, $1000, $1500, etc) is not the max that Parties are responsible for. If damage/s exists beyond Parties coverage amount, Euphoria Vacation Homes will document this with photos and provide professional estimates of repair and bill Parties for the repairs/replacements.
- CAPACITY RESTRICTIONS: Parties will update guest count as appropriate prior to arrival, additional guests not indicated on the reservation may incur a $40 per guest per night fee. Homes are staged according to guest count, additional guests not on the reservation will not have appropriate accommodations set up. Euphoria Vacation Homes properties are limited to the capacity stated in each listing. These limitations are set based upon sleeping arrangements, insurance, and local ordinances. Parties that exceed the capacity restrictions will be immediately asked to vacate the home with no refund. The property is only to be used as a personal vacation home by approved guests. The reserving guest is responsible for all Parties that use the property during the dates of their reservation. The guest count may not exceed Max Occupancy for the property at any time. If the home is used, in any way, by more than max allowed guests (without written approval for additional dinner guests, Parties, etc), (i) Parties may be required to immediately leave the home; (ii) Parties are breach of this Agreement; and (iii) Parties forfeit their right to a refund of any monies collected.
- RESERVATIONS: All Reservations are subject to Management and Property Owner approval. Online rates are subject to change without notice. Should there be ANY issues with the reservation, Parties will be contacted within 48 hours.
- ARRIVAL & DEPARTURE: Check-in time is no earlier than the time indicated within the listing and check-in instructions, take your time, all properties are self-check-in, and Parties can arrive at any time after the indicated/agreed upon check-in time. This time may be delayed should unforeseen circumstances arise. Check-out time is NO LATER than the time indicated within the listing and checkout instructions. Early Check-In and Late Checkout options are available for an additional fee if available, Parties must have approval in writing and a fee of $25/hr must be paid in advance. Unapproved early arrivals and late departures will incur a fee of $100 minimum, and $100/hr thereafter. If there are any discrepancies between signage in the home and messages sent by Euphoria Vacation Homes, written communication is the most up to date and valid information.
- UNAVAILABILITY: For any reason beyond the control of Euphoria Vacation Homes, the rental become unavailable, Euphoria Vacation Homes may substitute a comparable unit or cancel this Agreement and refund in full all payments made by Parties.
- STRICT NOISE ORDINANCE: Euphoria Vacation Homes abides by and enforces the county’s noise ordinance. No loud noises, music, loud vehicles are allowed between the hours of 10:00 pm and 7:00 am. Please note that excessive noise complaints will be taken seriously, and Parties will be in breach of this Agreement and asked to leave immediately.
- CLEANING: Properties will be delivered to Parties in a professionally cleaned condition, Parties agree to inform Euphoria Vacation Homes in writing of any cleaning issues upon arrival. Should Parties use and activity require more than regular cleaning services, Parties will be charged for associated excess costs. Photos and details will be provided by Euphoria Vacation Homes prior to processing payment. All bodily fluids/solids will incur an additional biohazard fee of $50 in addition to excessive cleaning fee.
- PETS: For pet friendly properties: Parties must submit in writing to Euphoria Vacation Homes the intent to bring a dog(s) and provide details about the dog(s), pet restrictions are indicated within the listing. The non-refundable pet fee is $30/Dog/Night, $175/Dog/Week, with a maximum of $300/Dog/Month, a $500 fine will be imposed if any evidence of a pet is submitted without prior-authorization and payment. The pet fee does not cover any damage caused by Parties pet. If Euphoria Vacation Homes discover pet damage, they will provide photos and a quote with fair pricing prior to processing payment. Parties agree dog(s) are fully housebroken, will be freshly bathed prior to arrival and will be treated with flea and tick meds within 30 days before arrival. Parties agree that dogs will not be left unattended in the rental for an extended period. Parties agree to comply with County ordinance which states, “Any dog which causes frequent, habitual, or long continued noise which is plainly audible across the property line of the animal owner, lasting 30 minutes or more while the animal is unprovoked is in violation,” and Parties will be required to leave.
- NO SMOKING/VAPING: No smoking/vaping is allowed within the home or 20 feet of any window or access point. If smoking within these areas does occur, (i) Parties will be responsible for all damage caused by the smoking including, but not limited to, stains, burns, odors, and removal of debris (lingering smoke smell, burns and stains incur a charge of $500 minimum; debris incur a charge of $100/butt); (ii) Parties may be required to immediately leave the Property; (iii) Parties will be in breach of this Agreement.
- LOST ITEMS OR LEFT ITEMS: Euphoria Vacation Homes assumes no responsibility for lost, stolen or abandoned items. A reasonable effort will be made to contact Parties to discuss return options. There will be a $50.00 minimum shipping & handling charge, larger items will be charged $25.00 handling plus shipping costs for any found items returned at Parties request. Euphoria Vacation Homes shall not be held liable for the condition of said items. Any items not claimed for longer than 30 days may be donated or sold.
- MAIL SERVICES: Parties may ship directly to the home that Parties are staying in using Fedex or UPS while Parties are in the home, Euphoria Vacation Homes cannot guarantee the delivery or security of the package. This will be up to the shipping client and the shipping receiver to arrange. **Euphoria Vacation Homes is not responsible for any lost, damaged, or delayed deliveries. Returning late deliveries after Parties have left will be considered a lost or left item and incur the same fees.
- PARTY/EVENT: Not all Euphoria Vacation Homes are event/party friendly. Please confirm any details with Euphoria Vacation Homes in writing prior to Parties reservation. Disruptive events could result in being asked to leave and no refund will be issued. **Event friendly homes do have additional fees and deposits required for events.
- ILLEGAL SUBSTANCES: No illegal substances are allowed in the rental, and minors should not be in possession of alcohol. Violations will result in being asked to leave the property and no refund will be issued.
- TV/CABLE/INTERNET/SATELLITE: No refund shall be given for number of devices, outages, content, lack of content, or personal preferences regarding cable/internet/satellite service please refer to the listing for specific amenities prior to Parties reservation. Services are provided as a convenience only and are not integral to this Agreement. Euphoria Vacation Homes will make every effort to troubleshoot and repair all devices affected by outages but does not take responsibility for service interruptions caused by situations out of their control.
- AIR CONDITIONING/HEATING: Our rentals are equipped with heating & air conditioning. Parties agree that air conditioning shall not be set below 72 degrees and heat shall not be set above 78 degrees, and that the fan setting shall be on ‘Auto’. Doors and windows shall be closed when either heat or air conditioning is in operation. There are no refunds for lack of, or malfunctioning HVAC units. Euphoria Vacation Homes will make every effort to service units in a timely manner with contracted HVAC vendors. All HVAC units are regularly maintained and serviced.
- POOL HEAT: When applicable, pool heating is an additional fee and must be paid for prior to use, please refer to listing’s amenities. The cost for pool heat is $60/day or $350/week and use is contingent on natural elements, if too cold, pool heat will not be available, and payment will be refunded. Parties agree to not tamper with pool heat controls or manipulate the heater in any way. Pool heat shall not exceed 86 degrees. Parties understand that the area surrounding pool and spa may not be fenced or secure. Parties understand and agree to be responsible and liable for any damage/s that occur to the pool and spa and its support equipment through Parties misuse and/or negligence.
- SYSTEM(S) FAILURES: In the event the rental sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool, hot tub or other system or structural systems, neither the property owner nor the Euphoria Vacation Homes shall be liable for damages, and no refunds will be given for such failures. However, Euphoria Vacation Homes will make every effort to promptly repair or replace the failed system or equipment, and in such event, Parties agree to permit Euphoria Vacation Homes or its service provider to have reasonable access to the property to inspect and make such repairs.
- UNFORESEEN OCCURRENCES: Euphoria Vacation Homes will not assume liability for any loss, damage or inconvenience caused by but not limited to the following: weather conditions, natural disasters, pests, construction, acts of God, or other reasons beyond their control. No refunds available, such instances are beyond the control of Euphoria Vacation Homes. It is highly recommended that Parties consider travel and/or rental insurance (Euphoria Vacation Homes is not permitted/licensed to provide recommendations for insurance coverage).
- RULES & REGULATIONS: NO COMMERCIAL USE. Parties agree to comply with all rules and regulations that are posted within the home or delivered to Parties. Parties will not: (i) disturb, annoy, endanger, or interfere with neighbors; (ii) use the property for any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling, storing, or transporting illicit drugs or other contraband; (iii) violate any law or ordinance; or (iv) commit waste or nuisance on or about the property.
- ENTRY: Euphoria Vacation Homes representatives and agents have the right to enter the property, at any time, with ample notice (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed services; (ii) to verify that Parties are compliant with the terms of this Agreement; or (iii) in case of emergency (no notice will be given). While every attempt will be made to avoid this, Euphoria Vacation Homes representatives and agents have the right to enter the property, upon reasonable notice of at least 24 hours, to show the property to prospective or actual purchasers, tenants, lenders, appraisers, or contractors.
- PARKING: Parties agree to comply with the parking details outlined in the listing and check-in instructions provided to Parties by Euphoria Vacation Homes.
- TERMINATION OF OCCUPANCY: Upon checkout, Parties shall: (i) return all copies of all keys or opening devices to the property, including any common areas; (ii) vacate the property and surrender it to Euphoria Vacation Homes empty of all persons at agreed upon time; (iii) vacate any/all parking and/or storage space; and (iv) deliver the Euphoria Vacation Homes in the same condition less ordinary wear and tear as received upon arrival.
- UNFORSEEN CIRCUMSTANCES: Euphoria Vacation Homes cannot be held responsible for circumstances beyond their control. This includes excessive noise from construction, public/private events, wildfire/smoke, weather related interruptions, road closures, interruption of services and utilities or unexpected appliance breakdown.
- PERSONAL PROPERTY AND INJURY: (i) Owner Insurance: Parties personal property, including vehicles, are not insured by Owner or, if applicable, HOA, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. The owner/Euphoria Vacation Homes does not insure against personal injury to Parties due to any reason other than the condition of the property. (ii) Guest Insurance: Euphoria Vacation Homes recommends that Parties carry or obtain insurance to protect Parties and their personal property from any loss or damage. (iii) Indemnity and Hold Harmless: Parties agree to indemnify, defend, and hold harmless Owner and Euphoria Vacation Homes from all claims, disputes, litigation, judgments, costs, and attorney fees resulting from loss, damage or injury Parties or their personal property.

Mediation fees, if any, shall be divided equally among the Parties involved.
- JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other guest.
- ENTIRE CONTRACT: All prior Agreements between Euphoria Vacation Homes and Parties are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the Parties` Agreement and may not be contradicted by evidence of any prior Agreement or contemporaneous oral Agreement. The Parties further intend that this Agreement constitutes the complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving this Agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforceability of any other provision in this Agreement. The waiver of any breach shall not be construed as a continuing waiver of the same or any subsequent breach.
- RELEASE: In consideration of the right to visit the home, Parties agree to release to the fullest extent allowed by law, Owner and Euphoria Vacation Homes, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my children or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Euphoria Vacation Homes. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.
